Child Custody Overview
Under California law, child custody has two parts: physical custody and legal custody. Physical custody addresses the periods of time the child will be with and under the supervision of each parent. Legal custody addresses the rights and responsibilities of each parent to make decisions regarding the health, education and welfare of the child.
There are many variations to custody orders. If you and the other parent are not able to agree on a custody arrangement for your child, a judge will make the decision.
Custody and visitation can be decided on a temporary basis while the divorce is pending if there are immediate problems that have to be resolved.
Initial or "temporary" custody and visitation orders require careful consideration. They should not be treated lightly with the assumption that an unsatisfactory order will be corrected or modified later on, whether by mediation, evaluation or litigation. Custody orders established at the beginning of a case can sometimes be difficult to change months or years later.
